TERMS OF SERVICE;  CONFIDENTIALITY; & PRIVACY POLICY

If you choose to use Creative . Strategy . LLC.’s applications, use any of the features of this Site or buy any of the professional services and/or products, (collectively, the “Services”), you agree to abide by all of the terms and conditions of these Terms of Service between you and Creative . Strategy . LLC.

We may change, add or remove portions of these Terms of Service at any time, which shall become effective immediately upon posting. It is your responsibility to review these Terms of Service and by continuing to use this Site, you agree to any changes.

Your continued use of the services now, or following the posting of notice of any changes in these operating rules, will indicate acceptance by you of such rules, changes, or modifications.

We may change, suspend or discontinue any aspect of the Services at any time, including the availability of any Services feature, database, or content. We may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability.

You must be at least eighteen (18) years old or the legal age of majority in your jurisdiction to use this website or purchase any products or services. By using our services you represent and warrant that you meet this requirement.

Any materials shared with us will be treated as confidential and used solely for the purpose of providing the service.

Exclusions. Confidential Information does not include information that is publicly known, independently developed by the Receiving Party, or rightfully obtained from a third party. Acquiring publicly available information does not constitute a breach of this Agreement.

Due to the volume of materials we review, we cannot guarantee that ideas presented to us are unique and we are not restricted from working with other companies in similar spaces.

Materials will not be shared publicly or distributed except as necessary to provide the service.

Advisory Only: Consulting services are intended to be educational and advisory in nature. Creative . Strategy . LLC. does not represent or endorse the accuracy or reliability of any advice, opinion, statement, or other information provided. You acknowledge that any reliance upon any such opinion, advice, statement, memorandum, or information shall be at your sole risk.

Recordings: Sessions may be recorded for Client and Company access. Recordings are confidential information. We reserve the right to delete recordings six (6) months after the session date unless otherwise agreed.

Cancellation: Scheduled sessions are forfeited if cancelled with less than 24 hours notice or if a Client is a “no-show”.

Immediate Access: All products (including templates, courses and guides) are digital goods.

Delivery: Access is granted electronically via email or secure portal immediately upon payment.

Customer Responsibility: Access is deemed “delivered” once the link is generated. If access is not received, it is the customer’s responsibility to contact help [at] Creative . Strategy . LLC. within 24 hours.

Creative . Strategy . LLC. may send electronic mail to you for the purpose of changes or additions to these Terms of Services when applicable and/or products and services agreed upon.

Limited License: Your purchase grants you a limited, single-user, non-exclusive, non-transferable license for personal or internal business use.

Restrictions: You may not resell, redistribute, sub-license or “leak” any content. All materials remain the exclusive property of Creative . Strategy . LLC. Sharing login credentials is immediate grounds for termination without refund.

You represent, warrant and covenant (a) that no materials of any kind submitted will (i) violate, plagiarize, or infringe upon the rights of any third party, including copyright, trademark, privacy or other personal or proprietary rights; or (ii) contain libelous or otherwise unlawful material.

You hereby indemnify, defend and hold harmless Creative . Strategy . LLC. and all officers, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the “Indemnified Parties”) from and against any and all liability and costs, including, without limitation, reasonable attorneys’ fees, incurred by the Indemnified Parties in connection with any claim arising out of any breach by you or any user of your account of these Terms of Service or the foregoing representations, warranties and covenants. You shall cooperate as fully as reasonably required in the defense of any such claim. Creative . Strategy . LLC. reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

THE SERVICES ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. YOU HEREBY ACKNOWLEDGE THAT USE OF THE SERVICES PROVIDED BY CREATIVE . STRATEGY . LLC IS AT YOUR SOLE RISK.

No Guarantees: We do not guarantee fundraising success, revenue increases or specific business outcomes.

Liability Gap: To the maximum extent permitted by law, the Company’s total liability is strictly limited to the total amount paid by the Client for the applicable product or service.

You agree to indemnify Creative . Strategy . LLC. and its members against any claims, damages or legal fees arising from your misuse of our products, breach of these Terms of Service, or reliance on information provided on our website.

We are not liable for delays or failures caused by events beyond our reasonable control, including but not limited to Internet outages, server failures, governmental actions, forces of nature, acts of God, illnesses and diseases.

All fees will be prepaid. Payment is required to obtain services.

All Sales are Final.

Statutory Exceptions:  Except as  required by Massachusetts local consumer law, all payments are non-refundable.

Discretionary Refunds:  Any refunds issued are at the sole discretion of the Company.

In the event there is a breach of confidentiality as contained in this Terms of Service Agreement, the party that was harmed by the breach of confidentiality may seek injunctive relief and any other remedies available under Massachusetts law.

Creative . Strategy . LLC. may, in its sole discretion, terminate or suspend your access to all or part of its Services for any reason, including, without limitation, breach or assignment of these Terms of Service.

If any provision of these Terms of Service is found to be unenforceable, the remaining provisions shall remain in full force and effect.

These Terms of Service are governed by the laws of the State of Massachusetts, USA. Any disputes shall be resolved first through mediation. If mediation is unsuccessful, then binding arbitration shall be pursued in Middlesex County, MA. If arbitration is found to be unenforceable in the jurisdiction where you or your company conduct business, you consent to the exclusive jurisdiction of the State and Federal Courts located in Massachusetts.

These Terms of Service have been made in and shall be construed and enforced in accordance with Massachusetts law. Any action to enforce these Terms of Service shall be brought in the federal or state courts located in Middlesex County, Massachusetts.

Notwithstanding any of the foregoing, nothing in these Terms of Service will serve to preempt the promises made in Creative . Strategy . LLC. Privacy Policy.
